An agent must be appointed for each ship of war1 in commission2, whose duty it is, in the name of the ship, or of the officers and crew or any of them, to take any necessary steps or proceedings in cases where prize money may be payable3. The post of agent may be held by a partnership body4, but it may not be held by anyone holding office or employment under the Crown5. The appointment must be made by attested instrument in a prescribed form signed by the commanding officer6, and the instrument must be registered with the Secretary
