In claims under the pre-2005 scheme by or in respect of members of the regular forces1, the burden of proof varies according to whether the claim in respect of a disablement is made, or the death in respect of which a pension is claimed occurred, before or after the expiration of seven years from the termination2 of service. Where seven years have not so elapsed, the claimant must show some disablement3, but once this is done in no case is there any burden
