The Financial conduct Authority (FCA) has issued temporary guidance, applying for an initial period of three months, to a significant number of firms in the consumer credit sector. • On 9 April 2020, the FCA published its finalised temporary guidance to consumer credit firms dealing with customers needing coronavirus (COVID-19) related payment holidays for personal loans, credit cards and retail revolving credit (for example, catalogue credit or store cards) and overdrafts. The frontier worker permit scheme allows EEA and Swiss nationals who are primarily resident overseas but who have previously worked in employment or self-employment in the UK prior to IP completion day (11 pm on 31 December 2020), to be able to continue to enter the UK in order to work here, without requiring permission under the post-Brexit immigration system. A frontier worker permit holder retains protection while they remain primarily resident outside the UK (as defined), and the route is not intended to lead to settlement in the UK. It is open to a person with pre-settled status under the EU Settlement Scheme (EUSS) to apply for a frontier worker permit where it becomes clear that they will not be able to meet the residence requirements for settled status. The permit has been more popular than initially anticipated, and there were 6733 permits issued in the year ending June 2021. Insurance & Reinsurance analysis: The Court of Appeal has given a further COVID-19 business interruption judgment on two important issues. First, whether each insured company under a composite policy was entitled to a separate limit of indemnity or, as insurers contended, the limit was an aggregate limit applicable to all insureds collectively. The Court of Appeal held in favour of insureds on this point. Second, and considered for the first time by the Court of Appeal, whether insureds must give credit for furlough payments received during the pandemic when calculating their business interruption losses. The Court of Appeal held, on the wording of the policies in this case, that they did.
