Children's Best Interest definition

What does Children's Best Interest mean?

The concept of children’s best interests derives from Article 3 of the UNCRC which states: ‘In all actions concerning children, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities or legislative bodies, the best interests of the child shall be a primary consideration.’ The UK GDPR (or EU GDPR) does not refer to this concept specifically however, the ico will take it into account when considering compliance and that organisations should consider ‘best interests’ when making decisions about the processing of children’s personal data.
