(5)     Disputes over statutory sick pay and other statutory payments

Statutory sick pay is included in the definition of wages set out in ERA 1996 s 27(1) (see para [338] ff). As a result, it might be expected that disputes about whether an employee has received the correct amount of statutory sick pay from his employer could be determined by means of a deduction from wages claim and it is not uncommon to see such claims included on employment tribunal claim forms.
