435. Acquiring authority's referral of counter-notice to the Upper Tribunal.
Compulsory Acquisition of Land (Volume 18 (2022)) | Commentary
Where1 the acquiring authority refers a counter-notice to the Upper Tribunal2, the Tribunal must determine whether the severance of the land proposed to be acquired would:
-
(1) in the case of a house, building or factory, cause material detriment to the house, building or factory; or
-
(2) in the case of a park or garden,
