It is unlawful either:
(1) to establish or use1 a wireless telegraphy station2; or
(2) to install or use wireless telegraphy apparatus3,
except under and in accordance with a licence (a 'wireless telegraphy licence') granted by Ofcom4 under the Wireless Telegraphy Act 20065.
A person who contravenes this requirement commits an offence and is liable, on conviction, to a penalty6.
Ofcom may by regulations exempt from the requirement for a licence7 the establishment, installation or use of wireless telegraphy stations or wireless telegraphy apparatus of such classes or descriptions as may be specified in the regulations, either absolutely or subject to such
