Ofcom1 may, when awarding a Channel 3 licence2 to any person, make the grant of the licence to him3 conditional on his compliance before the grant with such specified requirements relating to the financing of the service as appears to it to be appropriate4, having regard to:
(1) any duties which are or may be imposed on Ofcom, or on the licence holder, by or under the Broadcasting Act 19905; and
(2) any information provided to Ofcom during the application procedure6 by the person to whom the licence is awarded as to his projected financial position during the period
