349. Application of legislation.

Every member of the reserve forces is subject to service law while:

  1.  

    (1)     in permanent service on call-out under any provision of the Reserve Forces Act 1996 or under any other call-out obligation of an officer1;

  2.  

    (2)     in full-time service under a commitment2;

  3.  

    (3)     undertaking any training or duty (whether or not in pursuance of an obligation)3; or

  4.  

    (4)     serving on the permanent staff of a reserve force4.

Members of the reserve forces falling into these categories are liable to the discipline provisions contained in the Armed Forces Act 2006 and if charged with any offence under those provisions may
