73.5.1 Contract with contracting party that is part of international group of companies

A contracting party may wish the contract to benefit other companies in the same group as itself. An example might be a patent licence agreement covering several territories, in which the licensee is a major pharmaceutical company. Such a licensee will often wish to include in the contract a definition of ‘affiliate’ (eg its subsidiaries in particular territories covered by the licence) and provide that both it and its affiliates may exploit the licence.
