This Practice Note deals with the determination of the terms of a renewal lease by the court under the Landlord and Tenant Act 1954 (LTA 1954), ss 32–34, in the event that the parties cannot reach agreement, in respect of the premises, commencement and duration of, and the rent payable under, the new 1954 Act lease under LTA 1954, s 34, including in respect of improvements, service charges, rent review and the evidence required in that regard, the impact of the Landlord and Tenant (Covenants) Act 1995 (LT(C)A 1995), rent deposits, the determination of the other terms of a new 1954 Act business lease by the court under LTA 1954, s 35 including in respect of break options, guarantors, repairs, reinstatement and alterations, and service charges, rent deposit deeds, and the impact of LT(C)A 1995.
