This Practice Note sets out how a party to arbitration proceedings governed by Singapore law can apply (make an application to) to challenge the jurisdiction of an arbitral (arbitration) tribunal pre and post (before and after) an award has been issued, and also how a party may apply to the Singapore court for an anti-suit injunction restraining litigation (court proceedings) in favour of arbitration. The Practice Note covers challenging arbitrator jurisdiction under the Singapore Arbitration Act (Cap 10) and the International Arbitration Act (Cap 143A). It also covers the process of challenging an award on grounds of lack of jurisdiction. The Practice Note covers anti-suit injunctions in support of international arbitration proceedings and the availability of indemnity costs for breach of an arbitration agreement.
