Precedents

This Precedent is a set of online advertising terms and conditions for use where a publisher (being the owner of a website, app or other digital platform) sells digital advertising space on its platforms to advertisers or advertising agencies directly. The main body of the agreement is drafted as pro-publisher standard terms, often made available on the publisher’s website, with the main commercial variables set out in an order form (or insertion order). Special terms in the order form include example drafting for likely key pro-advertiser positioning.

Checklists

This Checklist is to be used when reviewing online advertising terms and conditions, where a publisher (being the owner of a website, app or other digital platform) sells digital space on its platforms to advertisers (brands or advertising/media buying agencies acting on behalf of such brands) directly (direct sales—either programmatic deals (ie completely automated) or standard direct (ie reservations of space on the publisher’s site)).
