This Practice Note, amended in light of the Insolvency (England and Wales) Rules 2016 by Lydia Pemberton of 3PB, discusses bankruptcy restrictions orders (BROs), which are orders imposing bankruptcy restrictions on a discharged bankrupt. This Practice Note considers who can apply for a BRO, at what point in time an application for a BRO can be issued, and the procedure for obtaining a BRO.

This Practice Note, produced in partnership with Lydia Pemberton of 3PB, sets out what bankruptcy restrictions undertakings (BRUs) are as alternative to bankruptcy restrictions orders, and summarises when and how BRUs are used in practice.

This Practice Note, amended in light of the Insolvency (England and Wales) Rules 2016 by Lydia Pemberton of 3PB, considers what effect a bankruptcy restrictions order (BRO) has on an individual, how long a BRO may last for, and how a BRO ceases to have effect.

This Practice Note provides a snapshot of some of the key provisions in the Fisheries Act 2020 (FiA 2020). This includes details on objectives and planning of fisheries management including joint fisheries statements (JFS), fisheries management plans (FMP), quotas, duty to consult, effect of the plans and reviews of the statements and plans. It also provides details on the licensing of fishing activities focussing on obligations, offences, discard prevention charging schemes, access to British waters by foreign boats, penalties and the licensing authorities. In addition, the Practice Note provides details on further powers of the Secretary of State and devolved governments and financial assistance. There is also guidance on increased research and conservation and expansion of the Marine and Coastal Act 2009 and greater protection for seals. The Practice Note finally considers Brexit and the UK’s new international fisheries relationships, focussing on the EU-UK Trade and Co-operation Agreement and some additional Fisheries Agreements with Norway, the Faroes, Greenland, Iceland and Svalbard.

This Practice Note explains the process of identifying special educational needs (SEN) and provision in England. It considers the reasons why distinguishing educational needs from other needs, such as health or social care needs, is necessary during the assessment process for children and young people with SEN and looks at the distinction for the purposes of Education Health and Care Plan (EHCP) and Statements of SEN.

This Practice Note, produced in partnership with William Willson of South Square Chambers and amended in light of the Insolvency (England and Wales) Rules 2016 by Lydia Pemberton of St. Philips Chambers, looks at income payment agreements (IPAs) made under section 310A of the Insolvency Act 1986 that allow trustees in bankruptcy to claim—for a limited time and with the agreement of the bankrupt—the bankrupt’s surplus income for the benefit of the bankruptcy estate.

This Checklist, amended in light of the Insolvency (England and Wales) Rules 2016 by Lydia Pemberton of 3PB, sets out the main steps to be taken and requirements to be met in order either for an income payments order (IPO) to be made or an income payments agreement (IPA) to be entered into.
