Nick Harding

Nick is a solicitor based in Bryan Cave Leighton Paisner, specialising in environmental and planning law.

Nick has experience carrying out due diligence on major corporate, real estate and energy transactions, advising clients of environmental regulatory matters such as waste management, environmental permits and greenhouse gas emissions, negotiating planning and highways agreements in relation to new developments, drafting and negotiating environmental warranties and indemnities and defending clients against judicial review litigation.

Recent examples of Nick's work includes:

• Successfully represented an infrastructure contractor regarding the defence of a judicial review claim brought against the grant of a bat licence granted by Natural England to allow enabling and construction works for the construction of a major national infrastructure project;
• Advised an infrastructure investor on the acquisition of a recently-consented solar farm, which once constructed will be the largest in the UK.;
• Advising an American private equity investor regarding investment into a UK-based water company in respect of environmental compliance;
• Successfully advised an Indian car manufacturer regarding the interpretation of the EU Regulation on the CO2 emission performance standards of new cars sold in the EU;
• Advised developers regarding nitrate neutrality issues associated with residential development schemes in the Solent and Stour catchment areas.

This Practice Note summarises the provisions in the Environment Act 2021 which relate to environmental governance, including the provisions relating to environmental targets, environmental improvement plans, environmental monitoring, a policy statement on environmental principles and statements and reports relating to environmental protection. It also covers the Environment (Air Quality and Soundscapes) (Wales) Act 2024 insofar as it relates to air quality targets.
