This Practice Note is archived and no longer maintained. It looks at the restructuring of Scottish company, Premier Oil plc, using two inter-conditional Scottish restructuring plans pursuant to Part 26A of the Companies Act 2006. It was the first time a Part 26A restructuring plan had been considered by the Scottish courts, only the fourth time a Part 26A restructuring plan had been considered (at that time), the first time a listed company had proposed a Part 26A Plan and potentially the first use of cross class cramdown (CCCD) under the new legislation.
