Practice Notes

This Practice Note addresses the scenario where a developer landlord wants to add additional storeys of lettable space on top of an existing, multi-let building. It considers the potential obstacles presented by the Landlord and Tenant Act 1987, the Leasehold Reform, Housing and Urban Development Act 1993, quiet enjoyment covenants, non-derogation from grant and the terms of the leases.

Precedents

This precedent transfer (HM Land Registry form TP1) is for use in the assignment of part of the land comprised in a registered lease. This leasehold assignment of part includes provisions apportioning the rent and other amounts payable under the lease (insurance and service charge) and responsibility for covenants which are not attributable to specific parts of the premises. It includes drafting notes summarising the approach which should be taken if the lease is ‘new’ or ‘old’ for the purposes of the Landlord and Tenant (Covenants) Act 1995.
