Emily Mailer
Emily specialises in all areas of trust and estate disputes and advises a range of clients, including families, individuals, trustees and beneficiaries, in this specialist area.
Emily's wealth of experience includes conducting cases concerning the validity of Wills, claims under the Inheritance (Provision for Family and Dependants) Act 1975, breach of trust claims, construction proceedings and rectification applications, and applications to remove executors and trustees.
She has also built up considerable experience dealing with disputes where there are offshore assets at stake. This involves coordinating lawyers in other jurisdictions (including Jersey, US and BVI) and considering the impact of succession to those assets as part of the litigation or alternative dispute resolution.
Emily also handles Court of Protection applications (both contested and uncontested) for the appointment of deputies and the approval of statutory wills and gifts.
Emily is ranked in Chambers HNW and Legal 500 as a leading individual in private wealth disputes. She is recognised as someone "who understands the nuances which arise in what is often family-based litigation" and has been described as "everything you want in a fellow professional litigator".
