Practice Notes

Sports governance is fragmented in nature, with governing bodies being separated out by, among other things, sport, tier, geography and gender and imposing rules on member organisations predominantly via contract.Alongside this fragmentary environment, practitioners are working in a field which is often subject to public scrutiny by an emotive and committed fanbase, making sports governance an answerable beast, in what is a fast-moving and often complex regulatory area. For example, in April 2021 12 major European football clubs announced plans to join the breakaway European Super League, resulting in protests by fans and, ultimately, public apologies and withdrawals from club owners (not reported by LexisNexis®). Examples such as this demonstrate the tension that exists between the (often commercial, profit-driven) enterprises managing competitions, tournaments or leagues; the clubs or sportspeople that compete within those structures; and the fanbases that those organisations rely on. Policies of sports governance bodies can be driven as much by public opinion as the regulatory landscape or their own commercial interests,
