Eddie Fardell
Partner / Joint head of Department,
Thomson Snell & Passmore
Eddie is recognised in Chambers UK 2013 as a leader in his field and is described as 'impressive'. Eddie was one of the first professionals to be appointed to the Court of Protection Professional Deputies Panel. He is often referred work direct by the Court and regularly appears before the Senior Judge of the Court of Protection. He receives many instructions to act as an expert witness in Court of Protection matters by other firms of solicitors, including instructions to act as a joint expert. Eddie regularly speaks at seminars on Court of Protection and related issues. He has been a member of the former Public Guardianship Office Professional Receivers Forum since 2003 and is now a member of the Court User Group. He has recently contributed blog posts to the Private Client Adviser:
The Court of Protection got it spot on in Re JDS
about Senior Judge Lush's judgement in the case of Re JDS and cases where, post settlement, the emphasis has been on inheritance tax mitigation rather than making the victim's life as fulfilling as possible.
The good old days of the Court of Protection
about the changes resulting from the The Mental Capacity Act 2005.
Protecting the financial awards of clients,
about the issues faced by deputies during the investment of a client's finances.
True Picture
a recent case about capacity proves the importance of disclosing all relevant medical evidence to the court. Profile Eddie joined Thomson Snell & Passmore in 1976 and became a partner in 1990. Eddie has concentrated on building up the firm's Court of Protection practice and the firm is now widely considered to be one of the leading players in the field with a large and dedicated team specifically dealing with this area of law. He now acts as the Court of Protection Deputy in 190 cases. In particular, he acts for many clients who have suffered a brain injury, usually as a result of an accident, and is therefore instrumental in handling high value damages claims. Eddie heads up the Court of Protection team and works closely with our Clinical Negligence and Personal Injury team. Author of:
