Elizabeth-Anne Larsen is a Senior Associate – Solicitor Advocate in CMS’ London office, specialising in both regulatory and litigation primarily in the fields of product liability, lifesciences, consumer products, tech, media, and healthcare. Elizabeth-Anne is an active member of the Product Liability, Life Sciences & Healthcare, Consumer Products, and Disputes sector groups at CMS.  She also leads various associate groups by serving as Co-Head of CMS’ Global Life Sciences and Healthcare Associates Group, as Co-Head of the UK Life Sciences Associates Group, and she established and leads CMS’ Global Product Liability Group.
 
Elizabeth-Anne is dual-qualified in both the US (Texas) and England & Wales.  She has vast experience in both jurisdictions in various matters of life sciences and healthcare law, including advising life sciences, consumer products, tech, and media companies on regulatory, compliance, and liability issues; managing multi-district litigation (US) and group litigation (UK) and other disputes involving product liability and various pharmaceutical and medical device products; advising on digital health/telemedicine (including authoring CMS UK’s digital health/telemedicine expert guide); and representing life sciences and healthcare companies in claims and at inquests. Elizabeth-Anne often presents at webinars and seminars on product liability, class actions, and litigation topics. Elizabeth-Anne actively engages with CMS' equIP Life Sciences Programme, assisting and supporting start-up life sciences companies, and assists with the annual production of the CMS’ highly acclaimed European Class Action Report.  She is also actively involved in UK and European trade associations in medical device, biotech, tech, and consumer sectors, broadening the depth of perspective she can provide when advising global clients.

This Practice Note summarises the law on product liability and defective products under the Consumer Protection Act 1987 (CPA 1987). CPA 1987 imposes liability on producers of defective products. This Practice Note considers what constitutes a defective product under CPA 1987, who in the supply chain may be liable, their degree of liability and any contributory negligence issues, the type of damages that may be awarded and the various defences available to a producer. It considers significant case law impacting the definition of defect and burden of liability under CPA 1987 as provided for in Wilkes v DePuy and Gee v DePuy and also considers the plans for future reform in this area.
