Ireland—Constructive dismissal
Ireland—Constructive dismissal
Practice Notes

This Practice Note provides an in-depth analysis of the legal issues surrounding constructive dismissal in Ireland. It explains that constructive dismissal occurs when an employee resigns due to the employer's conduct, which makes continued employment untenable. This Practice Note outlines the high burden of proof required for such claims, emphasising the need for employees to demonstrate either a breach of contract or unreasonable behaviour by the employer. It discusses key case law, including the necessity for employees to exhaust internal grievance procedures before resigning, unless exceptions apply and highlights the importance of mitigating losses and the potential for compensation in successful claims.
