Practice Notes

In Ireland, unlike the UK, ‘without prejudice’ conversations between employers and employees do not benefit from statutory protections. Employers must be cautious therefore, as any discussions about mutually agreed termination (as an example) can be used as evidence in legal proceedings. This Practice Note examines relevant legislation and case law in this area, as guidance to practitioners.
