I9.433 Interests in possession in settled property

I9.433 Interests in possession in settled property

A person beneficially entitled to an interest in possession in settled property is treated as beneficially entitled to the property in which the interest subsists1. Furthermore where a person would have been entitled to an interest in possession in the whole or part of the residue of the estate of a deceased person had the administration of the estate been completed, the IHT legislation applies as if the interest in possession had vested2.
