I8.103 Beneficial entitlement under a settlement

A person beneficially entitled to a qualifying interest in possession in settled property is treated as though he were beneficially entitled to the settled property in which his interest subsists1, and it therefore forms part of his estate. Where an individual who has an interest in possession in settled property also owns property absolutely, and the two items of property have a higher value if valued as a whole than the sum of their separate values, both items of property are taken as a proportionate part of the higher value in establishing the value
