I5.522 The common grandparent condition

This alternative to the 25-year condition is that all the persons who are or have been beneficiaries in relation to the settled property are or were either:

  1.  

    •     grandchildren of a common grandparent, or

  2.  

    •     children, widows or widowers of such grandchildren who were themselves beneficiaries but died before the time when, had they survived, they would have become entitled as mentioned in the capital condition1

For this purpose a person's children are taken to include his illegitimate children, his adopted children, and his stepchildren2.
