There is no charge where an order is made under the Inheritance (Provision for Family and Dependants) Act 1975 or under the Inheritance (Provision for Family and Dependants) (Northern Ireland) Order 1979, which brings to an end an interest in possession during a person's lifetime1 even if it is a qualifying interest in possession (QIIP). The same applies where a QIIP is brought to an end as a result of an order under the Act, or the Northern Ireland Order, which stays or dismisses proceedings on terms set out in or scheduled to it2.
