I5.114 Accumulation trusts as settlements

Any trust that gives the trustees the power to accumulate income or distribute, at their discretion, will fall into the category at IHTA 1984, s 43(2)(b). Take, for example, property directed to be held on trust to distribute the income among a class of beneficiaries (at the discretion of the trustees) for a period of 125 years, and then for such of the members of the class as shall be living at the end of the period. This fairly obviously falls within both categories in IHTA 1984, s 43(2)(a) as well as within IHTA 1984,
