I4.149B Sums payable to third parties

Before 11 May 2000, contracts could generally only be enforced by the other party to the agreement.

However, as a matter of general Scottish law, and as a matter of English and Northern Irish statute law in relation to most kinds of agreement entered into after 10 May 20001, a third party to an agreement can enforce terms of it which are for his benefit. In Scottish law it is also necessary for the obligation to have become irrevocable by, eg, communication to the third party of the existence of the agreement2.
