I4.112A Special rate where deceased had an IIP which has been succeeded by discretionary trusts

If at the time of the deceased's death he had an interest in possession (IIP) in settled property, and the following requirements are fulfilled, the IHT charged on the settled property as a result of the death may be at a special rate charged under IHTA 1984, ss 54A, 54B.

This is by reference to the settlor's aggregation of chargeable transfers in the seven years before the property was settled rather than the deceased's aggregation in the seven years before his death (if that yields
