I12.1111 Settlements by will—possible purposes of trusts

The possible purposes are:

  1.  

    (a)     To protect the principal beneficiar(y)(ies) from their own improvidence, or from losing it all on divorce, or having it all spent on care home fees.

  2.  

    (b)     To determine the ultimate destination of property after the death of the immediate beneficiar(y)(ies), typically where the immediate beneficiary is a spouse or civil partner. The testator may want it to go in the end to the younger generation, to the testator's own relatives rather than the beneficiary's, or to a favourite charity.
