I11.363 Costs in the Upper Tribunal (Lands Chamber)

The Upper Tribunal (Lands Chamber) may make an order for costs of its own motion or on application by either party1. There is no presumption in the rules that costs will be awarded against the unsuccessful party, but it is likely that this will be the general approach, in the absence of some reason why the successful party should not recover his costs. There is no court fee in respect of an appeal to the Upper Tribunal (Lands Chamber) under IHTA 1984, s 222.
