Qualifying investing companies

D8.305 Requirements for qualifying investing companies

In order for the investing company to be a qualifying investing company, the following conditions must be satisfied1:

  1.  

    (a)     the investing company must not have a material interest in the company during the qualification period (see D8.306)

  2.  

    (b)     it must not subscribe for the relevant shares as part of any reciprocal arrangements (see D8.307)

  3.  

    (c)     it must not control the issuing company during the qualification period (see D8.308)

  4.  

    (d)     it must exist wholly for the purpose of carrying on a non-financial trade (see D8.310)

  5.  

    (e)     the shares the investing company
