C3.1812 CGT exempt assets—superannuation funds and annual payments

No chargeable gain or allowable loss accrues on the disposal of a right to, or to any part of1:

  1.  

    (a)     any allowance, annuity or capital sum payable out of any superannuation fund, or under any superannuation scheme established solely or mainly for employed persons and their dependants

  2.  

    (b)     annual payments due under deeds of covenant and not secured on any property

In HMRC's view (a) includes sickness, death and retirement benefits, from trade union funds where these are contractual; payments from friendly societies where there is no policy of assurance; and payments under
