C2.1202 Duration of a lease

There are rules for establishing the duration of a lease, which relate to leases of land or of other assets1. They differ from the property income rules2 for ascertaining the duration of a lease. The capital gains rules are as follows:

    •     where the terms of the lease include provision for the determination of the lease by notice given by the landlord, the lease is not treated as granted for a term longer than one ending at the earliest date on which it could be determined by notice given by the landlord3
