A7.215 Introduction to DOTAS hallmarks

Arrangements are notifiable under the DOTAS regime only where they possess one of certain 'prescribed descriptions'1. These prescribed descriptions, referred to as hallmarks, are set out in regulations2 and are the most determinative factors which will require disclosure under DOTAS. Different 'hallmarks' apply depending upon whether there is a promoter involved, and schemes devised in-house are only required to be disclosed by businesses that are not a 'small or medium-sized enterprise'3 (see A7.217). Often more than one hallmark may apply to a scheme, and a good understand of the hallmarks is required
