A6.339 Right of appeal against a data notice

Unless the issue of a notice has been approved by the Tribunal1 or the data required under the notice forms part of the data-holder's statutory records2, the data-holder may appeal against the notice, or any of its requirements, on the grounds that3:

  1.  

    •     it is unduly onerous to comply

  2.  

    •     the data-holder is not a relevant data-holder, or

  3.  

    •     the data requested is not relevant data

Notice of appeal, stating the grounds of appeal, must be given in writing within 30 days of the date on which notice
