A2.306 Remedies under HRA 1998

Apart from a declaration of incompatibility (see A2.303), HRA 1998 does not create any new types of remedy, but provides that a court or tribunal may grant such relief or remedy within its powers that it considers is just and appropriate1. According to the White Paper on the Human Rights Bill, 'the court or tribunal will be able to grant the injured person any remedy which is within its normal powers to grant and which it considers appropriate and just in the circumstances.
