Labor Code, Arts 298, 299 enable an employee to claim separation pay if their contract is ended due to redundancy or illness which prevents employment. Under Art 297, an employee terminated for just cause (serious misconduct, fraud, etc) is generally not entitled to separation pay.
Separation pay varies between half of one month's pay and one months' pay for every year of service. The amount depends on the circumstance.
