2.3     Other withholding

Garnishing by court order

If a court has given judgment against an employee whereby an employee has defaulted in a debt to a third party, the third-party creditor may apply to the court for a redirection ('garnishee') order to be issued to the employer to withhold a portion of the employee's wages and divert the amount withheld to the third-party creditor, until the judgment debt is repaid.

The order must leave the employee with a minimum amount to live off. The minimum amount varies between the different Australian States.

The employer must make payment of the amount
