Volume 92 (2015) Sentencing This revised title provides a detailed and comprehensive description of the sentencing powers of crown courts and magistrates’ courts, considering every different type and level of sentence that can be imposed by the courts on a convicted person, ranging from whole-life tariffs for the most serious offences to suspended sentences, community orders, fines and discharges. It also deals with the numerous additional orders that may be imposed on a convicted person to address specific types of offending behaviour (such as football banning orders, travel restriction orders etc), the courts’ powers to make orders restricting the freedoms of persons who have not been convicted of any offence, for example for the purpose of terrorism prevention or the prevention of sexual offences, and the making of orders for the compensation of victims of crime and the retrieval of criminal proceeds. The matters to which the court must have regard in sentencing, and the mechanisms through which the court is required to arrive at its decision, are fully explored, as are the principles underpinning the sentencing process. Finally, provision is made for the supervision and management of offenders post-sentencing and the release and recall of prisoners.
