The following Immigration guidance note provides comprehensive and up to date legal information covering:

  • Tier 2 (Sportsperson): documents required to be retained on the sponsor’s HR file—checklist

This checklist details the copy documents that must be kept on the sponsor’s file for a Tier 2 (Sportsperson) employee in accordance with the Home Office Tiers 2 & 5 Sponsor Guidance (SG). The documents can either be kept as paper copies or in an electronic format.

All documents must be retained throughout the period of employment and for the shorter of:

—one year from the date you cease to sponsor the employee, or

—if the employee is no longer sponsored by you, the point at which a Home Office compliance officer has examined and approved the documents

Note that this checklist only includes documents and retention times required to meet the sponsorship duties set out by the Home Office. Some of these documents may also need to be kept for other purposes and for longer periods of time in order to meet other legal requirements, eg in relation to illegal working legislation.

The sponsor may also be required to provide additional documents to the relevant governing body in order to meet the governing body’s requirements for sponsor or migrant endorsement. The published endorsement requirements of the relevant governing body should be referred to in each case.
