I act for [insert client’s name] in connection with a lasting power of attorney for property and financial affairs. I am trying to establish whether or not they have the requisite mental capacity to sign the document and understand that you are their GP/Medical Practitioner.

As part of the assessment the individual must be able to demonstrate that they can understand:

  1. what a lasting power of attorney is

  2. why they want to make a lasting power of attorney

  3. who they are appointing and why

  4. what powers they are giving to their attorney

In addition, the individual must be able to understand that their attorney will have, once registered, complete control over their financial affairs and, in essence, will stand in their shoes and be able to undertake any transactions which they would be able to do themselves. If they wish, the powers of attorney can be restricted within the document and they should understand the extent of any restrictions which have been included.

Further, the individual should appreciate that the power of the attorney will continue even if they lose capacity to make their own decisions but that they have the ability at any point to revoke the attorney provided
