Law360: The US Court of Appeals for the Third Circuit ruled that, under the Federal Arbitration Act 9 US Code § 4, US courts, not arbitral tribunals, get to decide whether disputes are subject to arbitration if a contract’s language is vague, upholding a win for a construction company that filed an Employee Retirement Income Security Act (ERISA) claim against a union benefit fund.
