Pensions analysis: In the determination by the Deputy Pensions Ombudsman of Mr D and Mr L (PO-14185, PO-14197), a complaint was upheld that an employer had failed to honour a contractual promise to make pension contributions at rates which would allow the resulting benefit accrual to match that which the complainants (who had been the subject of TUPE transfers) would have enjoyed had they remained in pensionable service with a former employer. Wyn Derbyshire of gunnercooke LLP looks at the decision.
