Pensions analysis: In the determination by the Deputy Pensions Ombudsman of Mrs S (PO-17636), the Deputy Pensions Ombudsman considered a complaint brought by a spouse who argued that the trustees of her late husband’s pension scheme had decided not to pay her death benefits without properly considering all the relevant facts. The Deputy Pensions Ombudsman concluded that the trustees were wrong to accept that their was no interdependency between Mr S and Mrs S and that no reasonable decision maker could have reached this conclusion based on the evidence before them. Wyn Derbyshire of gunnercooke LLP looks at the decision.
