Planning Analysis: In Wealdon DC, the Court of Appeal dismissed two conjoined appeals, upholding the High Court’s decision that planning permission for development in the vicinity of the Ashdown Forest Special Area of Conservation and the Ashdown Forest Special Protection Area (the European Site) and in the High Weald Area of Outstanding Natural Beauty (AONB) should be quashed. The inspector granting planning permission had made factual errors in assessing mitigation which undermined his finding that there were no likely significant effects on the European site.
