TMT analysis: the Court of Justice has agreed with Advocate General (AG) Tanchev that Article 8(2) of Directive 2006/115 prevents a Member State from excluding performers who are nationals of states outside the European Economic Area (EEA), from their right to share equitable remuneration. The court also agreed with the AG that under Article 8(2) of Directive 2006/115 it was not permissible to limit the right of equitable remuneration in such a way that only the producer of the phonogram concerned receives remuneration, and does not share it with the performer who has contributed to that phonogram.
