Pensions analysis: Where the accrual of pension entitlement extends over periods both before and after the deadline for the UK transposition of the EU Part-time Workers Directive 97/81/EC (ie 7 April 2000), the calculation of those rights is governed by the provisions of that Directive, including with regard to periods of service before 7 April 2000, according to the Court of Justice of the European Union (CJEU) in O’Brien v Ministry of Justice.
