Pensions analysis: While a legal opinion produced in respect of a type A contingent asset which follows the Pension Protection Fund (PPF) standard form was able to reduce the guarantor’s liability under its representation/warranty (clause 5.4), it did not have the power to restrict the scope of the guarantor’s guaranteed obligations under clause 2.1, according to the High Court in Caribonum Pension Trustee v Pelikan Hardcopy Production AG.
